Why This Policy Matters

The UCS policy does three important things at once:
Acknowledges that generative AI is already valuable and unavoidable.

This combination places the policy among the most mature public-sector AI governance documents to date.
How the Policy Understands Generative AI
The policy is refreshingly precise about what generative AI is and what it is not.
Generative AI is described as a system that produces text or other outputs by predicting patterns learned from massive datasets. Crucially, the policy emphasizes that these systems do not retrieve authoritative facts and do not verify accuracy. They generate content that sounds plausible, which is exactly why hallucinations are such a serious risk.
This distinction is not academic. It is the foundation for every restriction that follows.
The policy explicitly warns that AI systems may fabricate facts, fabricate citations, and confidently present falsehoods. In legal and judicial contexts, this is unacceptable without human verification.
Where AI Can Be Used in the Courts
The UCS does not ban AI. Instead, it defines acceptable assistance roles.
Permitted uses include:
Drafting first versions of internal documents such as memos, letters, or administrative content.
Editing for clarity, tone, and accessibility.
Summarizing large volumes of material for internal understanding.
Condensing long documents into structured outlines or briefs.
Even here, the policy insists on human responsibility for final content. AI is positioned as a drafting and productivity aid, never as a decision-maker or authority.
This reflects a critical principle: AI may assist cognition, but it may not replace judgment.
Where AI Becomes Dangerous
The policy is blunt about AI’s failure modes.
Hallucinations and Accuracy Risk
Generative AI is explicitly deemed unsuitable for legal research and legal writing when used in general-purpose tools. Even AI features embedded in established legal research platforms must be independently verified.
The responsibility for accuracy always remains with the human user.
Bias and Prejudice
Because AI models are trained on real-world data, they inevitably reflect historical and societal biases. The policy assigns users a duty to detect and remove biased or harmful language from any AI-generated content.
Bias is not treated as an abstract risk. It is treated as a foreseeable outcome that must be actively mitigated.
Confidentiality and Data Leakage
This is where the policy becomes especially strict.
Public AI models are assumed to expose anything entered into them permanently. Once confidential data is entered, control is lost.
As a result, the policy prohibits entering into public AI systems:
Personally identifiable information.
Protected health information.
Privileged or confidential material.
Court filings or documents submitted for filing.
Internal intellectual property, including source code.
Even documents that are currently public are treated as confidential because sealing or redaction may occur later. This is a forward-looking approach that most organizations still fail to adopt.
The Core Governance Principles
The policy articulates several principles that align closely with modern AI governance best practices.
Human accountability is non-delegable.
AI must never substitute for judicial discretion or ethical responsibility.
Confidentiality rules apply fully to AI.
Using AI does not weaken existing privacy or secrecy obligations.
Ethical frameworks remain in force.
In other words, AI does not create exceptions. It inherits the full weight of institutional ethics.
Mandatory Restrictions and Operational Controls
Section V of the policy moves from principles to enforceable rules.
Key requirements include:
Only AI tools approved by the Division of Technology and Court Research may be used.
Mandatory initial and ongoing AI training for all users.
Absolute prohibition on using public models for confidential or court-related content.
No installation of AI software or paid tools without institutional approval.
No personal use of AI on court-owned devices.
Importantly, even approved AI tools may be restricted further by judges or supervisors depending on context.
Approval means technically safe, not universally appropriate.
Approved AI Tools and What That Signals
The appendix is revealing.
Approved tools include private, enterprise-controlled systems such as Microsoft Azure AI Services and Microsoft 365 Copilot within government-controlled tenants. Public tools like the free version of ChatGPT are allowed only with strict limitations, and paid subscriptions are explicitly prohibited.
This distinction reinforces a key lesson for legal AI vendors: deployment architecture matters as much as model capability.
Private models, data isolation, tenant control, and auditability are no longer optional features. They are prerequisites.
What This Means for Legal Professionals
For judges and court staff, the message is clear: AI can help you work faster, but it does not change your ethical or professional obligations.
For lawyers, especially those practicing before courts, the policy signals how judges are thinking about AI-generated content. Any AI-assisted filing that contains errors, hallucinated citations, or undisclosed reliance risks credibility and sanction.
For law firms, this policy is a compliance template waiting to be adapted.
What This Means for Legal-Tech Builders
For companies building AI for legal environments, the UCS policy is a warning and an opportunity.
Products must be:
Privacy-first by design.
Capable of operating in private or sovereign environments.
Explicit about limitations and verification requirements.
Built with auditability, governance, and refusal logic.
Tools that treat AI as a black box shortcut will not survive in regulated legal ecosystems.
The Bigger Picture
This policy is not anti-AI. It is anti-irresponsible AI.
It recognizes that the future of legal work will involve intelligent systems, but insists that trust, accountability, and human judgment remain the foundation of justice.
For the legal community, this is not merely a court policy. It is a preview of the standards that will define defensible AI across the profession.
