The Five AI Governance Failures That Will Define Legal Malpractice in 2027

Malpractice law has a predictable structure: a new category of professional error emerges, courts begin assigning liability, and within a few years the standard of care is redefined. What was once an edge case becomes the baseline expectation.

AI governance is moving through that cycle right now. Faster than most attorneys realize.

The sanctions decisions of 2025 and 2026 are not just enforcement actions. They are the early case law of a new malpractice standard. The attorneys who understand that now will build the governance frameworks that protect them. The ones who do not will become the precedents everyone else cites.

Here are the five governance failures that will define legal malpractice claims in 2027.

Failure 1: No Citation Verification Protocol

This is already happening. Multiple courts have imposed sanctions for AI-generated citations that referred to cases that do not exist, or that said nothing like what the brief claimed.

By 2027, the malpractice standard will be clear: an attorney who files a brief containing AI-generated citations without running a documented verification protocol has failed to meet the standard of care. Not because AI is prohibited. Because the verification step was available, known, and skipped.

There has been a lot of publication about hallucinated cases, and people should be aware. By 2027, that awareness will be presumed.

What governance looks like:

  • A written, step-by-step citation verification workflow

  • Every case confirmed to exist and to say what the brief claims

  • Confirmed to be current law, documented, signed off, and repeatable

Failure 2: Client Data Processed Through Consumer AI Terms

When an attorney pastes a client's contract, deposition summary, or privileged communication into ChatGPT, Gemini, or any consumer AI tool with standard terms of service, they are making a unilateral decision about that client's data without the client's knowledge or consent.

Those terms typically include data retention provisions, potential model training uses, and third-party processing rights. ABA Model Rule 1.6 requires reasonable measures to prevent unauthorized disclosure of client information. By 2027, use of consumer AI tools for client work without a documented data governance evaluation will be a straightforward Rule 1.6 exposure.

What governance looks like:

  • A documented AI tool evaluation for every platform used in client matters

  • Coverage of data residency, retention, training provisions, and third-party access

  • Vendor agreements reviewed and retained with client notification protocols where required

Failure 3: No Human Checkpoint

AI tools produce errors that are often syntactically plausible and substantively wrong. A contract clause that sounds correct but inverts the obligation. A regulatory citation that existed in a prior version of the rule. A case summary that accurately describes the holding but misses the circuit split that controls.

By 2027, the question in a malpractice deposition will be: who reviewed this output, what did they check, and how do you know? A read-through by the signing attorney will not be sufficient when the error was the kind that a structured verification step would have caught.

What governance looks like:

  • A named, accountable human reviewer for every AI-assisted work product

  • A documented checklist of what was verified before delivery

  • An audit trail showing the review occurred before the document reached the client or court

Failure 4: No AI Incident Response Protocol

When an AI governance failure produces a client harm, the response in the first 48 hours determines whether the matter is resolved professionally or escalates into a disciplinary complaint.

Most firms have no AI incident response protocol. The response is improvised, inconsistent, potentially self-incriminating, and almost never optimally protective of the client's interests or the firm's professional standing.

By 2027, the absence of a written AI incident response protocol will itself be cited as evidence of governance failure, not just the underlying error.

What governance looks like:

  • Written protocol for how AI errors are identified and escalated internally

  • How the client is notified and what remediation steps are taken

  • How the matter is documented for professional responsibility purposes

  • Under what circumstances outside counsel is engaged

Failure 5: AI Governance Treated as IT Policy

This is the meta-failure that enables all the others.

In most firms, AI governance lives in the IT department. Acceptable use policies. Software procurement standards. Security protocols. These are necessary. They are not sufficient.

Professional responsibility in the use of AI is not an IT question. It is a legal question. An ethics question. A competence question. The obligation to understand the tools you use (Rule 1.1), protect client information (Rule 1.6), and supervise work product that bears your signature (Rule 5.1) are professional standards, not technology standards.

By 2027, the malpractice standard will distinguish clearly between firms that treated AI governance as professional responsibility architecture and firms that treated it as a technology policy.

What governance looks like:

  • AI governance owned by legal leadership, not delegated exclusively to IT

  • Written standards that reference professional responsibility rules directly

  • Training documented as competence development, not just software onboarding

The Window Is Still Open

None of these failures are inevitable. Each one has a governance solution, and every solution is implementable today, before a sanctions event, before a bar complaint, before a malpractice claim.

The firms that act in 2026 will have built mature, documented governance frameworks by the time the 2027 standard solidifies. The firms that wait will be building those frameworks reactively, under pressure, under scrutiny, and potentially under counsel.
