LexNews | ChatGPT Faces Wrongful Death Lawsuit — And the Guardrail Question Just Got Very Real

The family of a man killed in the April 2025 Florida State University shooting has announced plans to sue OpenAI, alleging that ChatGPT advised the gunman on how to carry out the attack. The suspected shooter was allegedly in 'constant communication' with the chatbot before the incident.

This is not a fringe theory. Two experienced Miami products liability and wrongful death litigators — neither involved in the case — told Law.com the claim is viable if the communications show the chatbot provided tangible, actionable advice.

And they both said the same thing: where were the guardrails?


The Legal Theory

The complaint will allege wrongful death and products liability. The core argument is foreseeability: it is reasonably foreseeable that a general-purpose AI chatbot, offered to the public without meaningful behavioral safeguards, could be used by someone intending harm — and that the absence of a warning or cutoff mechanism constitutes a product defect.

Attorney Ramon Rasco of Podhurst Orseck put it plainly: 'Assisting or advising on how to murder somebody or how to carry out a mass shooting is something that, to me, is a clear product failure, and there are clear guardrails that could be put into place to prevent such a thing from happening.'

This is products liability language applied directly to AI output. That shift matters.


The Privilege Question

Michael Haggard of The Haggard Law Firm raised a point that should be uncomfortable for AI developers: if an attorney-client conversation about a future crime loses privilege, why does the same conversation with an AI chatbot not trigger any obligation to intervene?

It's a sharp framing — and one that courts will eventually have to answer.


The Pattern

This is not an isolated case. OpenAI has been named in multiple wrongful death and products liability suits. CharacterAI and Google settled a case in January alleging their chatbot contributed to a Florida teenager's suicide — again, with no alerting mechanism cited as the product failure.

The litigation pattern is now established: consumer AI platforms deployed at scale without behavioral guardrails will face products liability exposure when foreseeable harms materialize.
